Bookings at Le Foulon are subject to Terms and Conditions included within a Rental Contract that will be provided at the time of booking.

GENERAL TERMS AND CONDITIONS.

RENTAL OF LE FOULON

SELF CATERING HOLIDAY ACCOMMODATION

Concerning: A FURNISHED HOUSE.

Comprising: X BEDROOMS in total - your bedroom requirement: X bedrooms for up to a maximum of XX people.

3 BEDROOMS on the fourth floor (all with extra double sofabed), 2 BEDROOMS on the third floor, 2 BEDROOMS on the second floor and 2 BEDROOMS on the ground floor, one with a set of extra children’s bunkbeds (5 super king bedded rooms and 4 super king or twin bedded all with en-suite bathrooms). 2 twin & 1 double bedded rooms (sharing a double shower room) AND 1 king bedded with en-suite bedroom (the Maurel rooms on the second floor). If you do not book all 13 bedrooms then the empty bedrooms will remain locked during your stay.

LARGE SITTING ROOM, BAR, TV/PLAY ROOM and DINING ROOM. Full use of COMMERCIAL STYLE KITCHEN. LIBRARY/OFFICE AREA & CONSERVATORY. HEATED POOL (open 01st May to 30th September)*. BBQ and TERRACE, OUTDOOR LOUNGE. PARKING and 5 HECTARES of river fronted land.

THIS CONTRACT DOES NOT COVER WEDDINGS OR LARGE EVENTS.

WE HAVE SEPARATE RATES FOR WEDDINGS AND WE CANNOT HOLD PARTIES WITH MORE THAN THE NUMBER OF PEOPLE YOU HAVE RESERVED TO STAY AT LE FOULON (MAX 34). IF YOU PLAN ON BRINGING A DJ/SOUND SYSTEM PLEASE TALK TO US FIRST ABOUT THE RESTRICTIONS. FIREWORKS ARE NOT ALLOWED IN THE NATURAL PARK WHERE WE ARE SITUATED AND OUTDOOR FIRES ARE PROHIBITED IN THE SUMMER BY THE FIRE DEPARTMENT.

ELECTRIC CAR CHARGING. THERE IS A 220V SOCKET IN THE COURTYARD. BY PRIOR ARRANGEMENT YOU MAY PLUG IN YOUR CAR FOR A FEE OF 6€ PER DAY
(and by knowing in advance we can reserve the space for you).

Located: 4kms before GREOLIERES VILLAGE, 06620 at Le Foulon, 4220 Route de Grasse.

Access to the grounds and the swimming pool, with the understanding that the house managers are permitted access at their discretion. The manager’s apartment is located in a building away from the guest areas.

GENERAL TERMS AND CONDITIONS

Clause 1:

The rental agreement shall be deemed definitively entered into when the deposit has been paid in full and effectively paid over.

It shall immediately become null and void should the effective cashing of any of the payments corresponding to the rental period not be possible and the occupier, without entitlement or title, may be evicted if necessary with the assistance of the Police.

Clause 2: Booking

The tenant shall pay a first installment of 30% of the rental price upon booking. The balance of the rental, shall be paid at the latest, 6 WEEKS before the date scheduled for the start of the lease (i.e. XX date). If the reservation is made within 6 weeks before the arrival date the rental amount shall be paid in full in booking.

Clause 3: Cancellation

Should the booking be cancelled by the lessee, the installment(s) paid shall remain wholly or partly the property of the lessor, automatically and without the requirement of formalities, as standard compensation under the following conditions and context:

  • CANCELLATION: all sums paid on the basis of the rental price will be withheld. If the lessor is able to re-sell the cancelled dates, then the installment(s) paid shall be refunded with the deduction of any bank charges incurred and discount required to resell the period.
  • We recommend you take appropriate holiday insurance to cover your deposit/final payment should you not be able to travel.

The lessor must be notified of the cancellation in writing, by e-mail or registered letter with acknowledgement of receipt. 
The cancellation will be effective upon the lessor’s receipt of the e-mail or letter.

Should the booking be cancelled by the lessor, for any reason, the lessor will propose other rental dates, or all sums paid shall be returned to the latter in full.

Clause 4: Length of stay

The length of the stay is as set down in the booking document.

Departure at an earlier date will not give rise to any refund.

Clause 5: Price

The rental price, specified hereabove excludes any credit card commission or money transfer fee, is always payable in advance and must be received before admission to the premises.

A deposit of 500 Euros only in cash will be required as a security deposit for any damage or breakages during the rental period.

Taxe de Sejour: The local commune levy a Tourism Tax. This is likely to be approximately 3.00 Euros per person per night depending on the amount of people in your group (children under 18 years old are exempt), the amount to be confirmed and can be paid on arrival by credit card (Visa or MasterCard) or money transfer or by cash in Euros.

Clause 6: Billing - Payment

Payment in Euros either by Credit Card (Visa or MasterCard), by 3D Secure SystemPay online (Credit Card Commission @ 1.5% outside the E.U. or 0.5% inside the E.U) or bank transfer by SWIFT/BIC (check with your bank for international transfer charges) are accepted. We do not accept cheques.

For a money transfer, the bank particulars are as follows:

Clause 7: The tenant’s obligations

Each tenant shall use the rented premises and facilities responsibly, in compliance with the provisions hereof.

Any use of the residence as official domicile either on a private or a professional basis is prohibited and the lessee recognises that the premises, subject to this agreement, are only rented to him or her on a temporary basis and for leisure purposes and only for the maximum number of people detailed above.

S/he may not avail him/herself of the legal provisions pertaining to accommodation leases, particularly the right to continue to remain on the premises.

The person in charge of the residence may enter the premises for maintenance purposes and to ensure that this agreement is satisfactorily complied with.

1°: The lessee undertakes not to substitute any other person for himself, nor to sub-let the premises, even free of charge and will not use the property for a marriage or event, except with the written agreement of the lessor.

2°: The lessee may not claim any reduction of rent should urgent repairs, incumbent upon the lessor, become necessary during the rental period.

Clause 8 : Internal regulations

Arrivals must take place, insofar as possible: between 4pm (at the earliest) and 8pm. (Please notify us of late arrival).

And departures before 10 am (at the latest). Departure time must be adhered to in order to ensure sufficient time for the cleaning and preparation of the house and gardens for the following guests.

The lessee shall refrain from throwing non-biodegradable objects into the toilets, washbasins, baths, or sinks which may block the pipes or septic tank, failing which s/he will be liable for the ensuing costs of repair.

Bed-linen is supplied, as is kitchen equipment. One bath sheet and one hand towel are provided per person on the day of arrival. Should the duration of the rental be for more than one week, then bedding and towels will be changed weekly. Should a cleaning service be required part way through a week a charge of 20€ per hour will be made, and charge of 42€ per room will be made for a bed linen & towel change. Towels are NOT provided for the pool but can be rented at 6€ per towel.

The residence does not possess special equipment for babies, young children or disabled persons.

Access to the 4.2 meter x 11 meter heated swimming pool is between May 01st and September 30th.

* It is the lessees’ responsibility to put the thermal cover on the pool every night (it is an easy and quick task and the lessee will be shown, in detail, how to do this at the start of the rental). If the pool is not covered at night you may be left with a cold pool or the option of an additional charge to heat it to a comfortable temperature.

Children under 12 are not admitted without an adult.

The depth of the water is between 0.8m and 2m.

There is no supervision. The pool terrace is fenced according to the Raffarin Law published in January 2004 French parliament and is NF P90-306 compliant.

Towels are not provided for the pool.

Parents are entirely responsible for supervising their children, especially when swimming in the pool or playing in the grounds. The group leader must sign an insurance waiver.

An initial supply of toilet paper, rubbish bags, washing powder, cleaning products etc. is provided on arrival but not replaced – this is the lessee’s responsibility.

Free wi-fi internet connection.

Le Foulon is strictly non-smoking and we ask that you do not smoke within the building. Should you smoke inside the building or the premises be left in such a state which would cause our cleaners extra work than usual, a 100 Euros charge will be deducted from your security deposit in cash. We ask you to please leave the property reasonably clean and tidy and return any furniture/games to its original place.

Well behaved animals will be considered, please inform us if you wish to bring an animal when making your booking, there will be a supplemental charge of 50 Euros per animal per stay.

Clause 9: Security deposit

In order to ensure the satisfactory performance of this agreement, on arrival, the lessor shall take 500 Euros only in cash, as a security deposit for any damage or breakages during the rental period.

At the end of the agreement, the cash shall be returned, subject to deduction of any sums owed by the lessee under the terms of this agreement and to the compensation, if applicable, for any damage noted.

We provide a home away from home, and trust our clients treat Le Foulon accordingly – rest assured our crockery and glassware is good value and any payments taken will be agreed between the two parties beforehand.

Clause 10: Inventory

* Drawing up the inventory:

THE INVENTORY shall be drawn up at the beginning of the stay in the presence of both the lessor and the lessee upon arrival.

Upon the day of departure of the lessee, the inventory will be checked and the final statement drawn up in the presence of both parties.

Should the lessee not wish to wait for the final statement to be drawn up, the latter will be sent to him, deduction having been made of any sums outstanding under the aforementioned terms, within a maximum time-limit of 15 DAYS.

* Evaluation of damages:

Any missing or damaged items shall be valued at the price of their replacement.

In the event of disagreement between the parties and should an expert opinion be required, the deposit shall be retained by the lessor, without paying interest to the lessee, throughout the duration of such expert appraisal and, if applicable, any legal proceedings which may ensue.

The expenses and fees for the expert appraisal shall be payable by the losing party.

Clause 11: Liability

The lessor cannot be held liable in the case of theft of or damage to the lessee’s personal belongings within the property, either in the rented private accommodation or in the common areas and parking areas.

All lessees must have Travel Insurance including CANCELLATION, SICKNESS AND ACCIDENT INSURANCE.

As the lessee is liable for any damage he causes, he is also advised to take out holiday insurance to cover the various risks.
